A Little About This Space

Cast-iron facades and cobblestone side streets make Soho one of Manhattan’s most iconic neighborhoods. With near constant footfall, big-name high-end brands like Bloomingdales, Brandy Melville, and Nike have set up shop here.

On Mercer Street, this two-floor store under a luxe apartment building has lots of room and lots of natural light from a large glass window in the front. The ground-level space is long and has polished concrete floors, built-in geometrical shelves, and painted brick walls. The basement is equally as big and separated into three rooms and break area with a sink included.

Rules of The Space

Certificate of insurance: $2 million of of comprehensive general
liability insurance coverage, and $1 million of property coverage. Both
policies should name landlord as additional insured. The name for the
landlord is as follows: 44 Mercer LLC Shushana LLC and Lipkis Family LP.

Amendments
1) Notwithstanding the references to landlord and tenant this is a license
agreement and not a lease.

2) 44 Mercer does not have wifi - you can have it installed but then you
are responsible for having the wifi deinstalled at the end of the lease as
well as fixing any damages to the space caused from installing/deinstalling
the wifi.

3) You are responsible for removing all garbage at the end of the lease -
this includes calling a commercial garbage collection company to come get
the garbage (the City does not pick up retail garbage. There are a number
of private companies who do it).

4) You will get the space just as you saw it on Friday (we will remove the
paper on the floor), white walls/floor etc. You can paint, build walls, put
down flooring, etc in the space, please just let us know what you are
planning on doing and the materials you are planning on using (we had a
case where pop-up did not tell us they were putting down a certain type of
flooring that when they took out that floor it damaged our cement floor and
they had to fix our floor. That could have been avoided because if we knew
what type of materials they were planning on using we could have warned
them about the floor). Any work that you do to/in the space needs to
removed and or fixed at the end of the lease. This includes, but is not
limited to re-painting the wall white, fixing any holes, etc. You can put
signs up in the window, but you are responsible for removing the sign and
cleaning any gunge left on the window caused by the sign.
